Prices for all Products are in United States dollars and exclude any and all applicable taxes and shipping and handling charges, unless expressly stated otherwise. ARBITRATION; NO CLASS ACTION

Any controversy or claim between you and Redneck Trailer Supplies arising out of or relating to these Terms and Conditions, or the breach hereof, will be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, including the AAA Consumer Due Process Protocol and the AAA Supplementary Procedures for Consumer Disputes. The AAA Rules are available at www.adr.org. The arbitration will take place at a location in Greene County, Missouri before a single arbitrator. The arbitrator will be selected by you and Redneck Trailer Supplies within 60 days after written notice is provided by one of the parties of a dispute. If the parties are unable to agree on an arbitrator within 60 days, the arbitrator will be selected in accordance with the applicable AAA Rules. If you seek an award of $10,000 or less, you may elect to proceed with arbitration without a hearing. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Redneck Trailer Supplies will promptly reimburse you for any filing fees incurred in connection with any arbitration proceeding, and Redneck Trailer Supplies will be responsible for all expenses of the arbitration (e.g., arbitrator fees). The arbitrator may award attorney’s fees to you in accordance with Missouri law, so long as such an award would not be duplicative.  NO PARTY MAY JOIN HIS, HER OR ITS CLAIMS WITH THOSE OF OTHERS OR BRING A CLASS-ACTION OR OTHER REPRESENTATIVE PROCEEDING, UNLESS THE BUYER AND SELLER OTHERWISE AGREE IN WRITING.

TERMINATION OF ACCESS

In addition to any other legal or equitable remedies for misuse, Redneck Trailer Supplies may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and Redneck Trailer Supplies shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.

SURVIVAL

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Redneck Trailer Supplies and its affiliates from and against any and all claims, damages, costs, and expenses, including without limitation, attorneys’ fees, arising from or related to your use of the Site or the Products.

REMEDIES
